The Minister of Communications and Informatics in Indonesia has issued Regulation No. 5 of 2024, establishing rules concerning the determination of Telecommunications Equipment and Devices Testing Centres. This regulation supersedes Ministerial Regulations No. 15 of 2012 (Guidelines for Recognition of Domestic Test Centres) and No. 16 of 2012 (Guidelines for Recognition of Overseas Test Centres). The key points of the new regulation are as follows:
1. Testing Requirements for Telecommunications Equipment:
All telecommunications equipment or devices manufactured, assembled, or imported for trade or use in the territory of the Republic of Indonesia must undergo testing to ensure compliance with technical standards as per the laws and regulations. These tests must be carried out by designated Testing Centres, which can be:
- Domestic Testing Centres accredited under ISO/IEC 17025.
- Overseas Testing Centres, either recognised through a Mutual Recognition Mechanism Agreement (MRA) or through a non-MRA mechanism.
The MRA is an agreement that facilitates mutual recognition of test laboratories and test results between Indonesia and other countries based on shared technical standards.
2. Non-MRA Overseas Test Centres:
Article 25 outlines that overseas test laboratories can be designated as an Overseas Test Centre through a non-MRA mechanism if they meet the following conditions:
- The laboratory is located in a country that does not have an MRA with Indonesia.
- The laboratory has been recognised before this regulation was enacted.
Applications for recognition under the non-MRA mechanism must be submitted to the Ministry of Communications and Informatics no later than November 1, 2024. The recognition granted will be valid until December 31, 2026.
3. Transition Period for Existing Test Centres:
Overseas Test Centres recognised before this regulation took effect will continue to be recognised until December 31, 2024, if they either fail to submit an application by the November deadline or if their application is rejected. During this transition period, they must comply with the new requirements to maintain recognition.
4. Supervision and Control:
The Director General of Domestic and Foreign Test Centres will conduct both routine and incidental inspections of the test laboratories. For Overseas Test Centres, at least one inspection will take place during the validity period of their designation, whether through the MRA or non-MRA mechanism.
